1. Introduction

These Terms & Conditions ("Terms") constitute a legally binding agreement between you ("you", "your") and GoalPhysique, a sole trader registered in the United Kingdom ("GoalPhysique", "we", "us"). By accessing goalphysique.com or any affiliated services, mobile applications or digital platforms (collectively, the "Service"), you confirm that you have read, understood, and agree to be bound by these Terms and by our Privacy Policy. If you do not accept all of these Terms, you must not use the Service.

The Service provides educational fitness content, a free online assessment, and a one-off purchase programme (the "Paid Programme"). All information is for general guidance only and is not medical advice.

2. Definitions

  • Account – the profile automatically created for you when you complete payment for a Paid Programme.
  • Assessment – the questionnaire used to generate preliminary fitness and lifestyle recommendations.
  • Content – any text, graphics, images, audio, video or other material made available via the Service.
  • User Data – information supplied by you during the Assessment, at checkout or through continued use of the Service.

3. Eligibility & Acceptance

You must be at least 16 years old to use the Service. If you are between 16 and 18 you confirm that you have permission from a parent or legal guardian. By accessing any part of the Service you warrant that you meet these requirements and accept these Terms in full.

4. Medical Disclaimer & Safety Notice

GoalPhysique is not a medical organisation and none of our staff provide medical diagnoses or treatment. All Content is provided on an "as-is" basis for educational purposes only. You acknowledge and agree that:

  • Participation in any exercise programme carries inherent risk. You assume full responsibility for your health and any injury that may result from your participation.
  • You should consult a qualified healthcare professional before starting any new exercise or nutritional regime, especially if you are pregnant, have pre-existing medical conditions, or are injured.
  • You are solely responsible for evaluating your own health and ability to participate safely.
  • If at any time you experience pain, dizziness or shortness of breath you should stop immediately and seek medical attention.

5. Account Creation & Security

An Account is created automatically when you purchase a Paid Programme. You are responsible for safeguarding your login credentials and for all activities that occur under your Account. Notify us immediately at support@goalphysique.com if you suspect unauthorised access.

6. Description of Services

  • Free online Assessment generating a preliminary evaluation.
  • One-off purchase Paid Programme delivered via secure Stripe checkout.

We reserve the right to modify, suspend or discontinue any part of the Service at any time.

7. Pricing, Payment & Money-Back Guarantee

a) Payment is processed securely by Stripe; we do not store your full card details.

b) The Paid Programme is a single purchase – no recurring subscription fees apply. We may change prices at any time but such changes will not affect an order you have already placed.

c) 30-Day Results Guarantee: Follow the Paid Programme as prescribed and, if you do not see measurable progress within 30 days, email us within 40 days of purchase to request a full refund. We may ask for reasonable evidence (e.g. training logs) of adherence. Approved refunds will be issued to the original payment method within seven business days.

d) You are responsible for any additional charges imposed by your bank or payment provider. Unauthorised chargebacks will result in immediate suspension of your Account until the outstanding amount (plus any fees) is settled.

8. Intellectual Property

All Content, trademarks, graphics and other intellectual property displayed via the Service belong to GoalPhysique or its licensors and are protected by applicable law. Except as expressly permitted by these Terms you must not copy, reproduce, distribute or create derivative works from any Content without prior written consent.

9. Acceptable Use & User Conduct

You agree that you will not:

  • Use the Service for any unlawful or fraudulent purpose.
  • Upload malware or any code intended to disrupt the Service.
  • Infringe our intellectual property or that of any third party.
  • Attempt to gain unauthorised access to the Service or other Accounts.

10. Third-Party Services & Links

The Service may contain links to third-party websites or integrations with third-party services (including Stripe). We have no control over and assume no responsibility for any third-party content, privacy policies or practices. Access is at your own risk.

11. Data Protection & Privacy

GoalPhysique is the data controller for personal data processed via the Service. We process personal information in accordance with the UK GDPR and the Data Protection Act 2018. Please review our separate Privacy Policy for details of how we collect, use and protect your data and the rights available to you.

12. Disclaimer of Warranties

The Service and all Content are provided on an “as is” and “as available” basis without any warranty of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, accuracy or non-infringement. We do not guarantee that the Service will be uninterrupted, error-free or secure.

13. Limitation of Liability

Nothing in these Terms excludes or limits liability that cannot be excluded under English law. Subject to the foregoing, GoalPhysique shall not be liable for any indirect, consequential, special or punitive losses, including loss of profit, data or goodwill. Our total aggregate liability arising out of or in connection with the Service shall not exceed the amount you have paid us in the 12 months preceding the event giving rise to the claim.

14. Indemnity

You agree to indemnify and hold GoalPhysique harmless from any claims, damages, losses and expenses (including reasonable legal fees) arising out of your breach of these Terms or misuse of the Service.

15. Suspension, Termination & Enforcement

We may suspend or terminate your access to the Service at any time, with or without notice, if we reasonably believe you have breached these Terms or engaged in fraudulent, abusive or unlawful behaviour. Upon termination the provisions of Sections 8, 12–14, 16–20 shall survive.

16. Force Majeure

We shall not be liable for any delay or failure to perform our obligations if such delay or failure results from events beyond our reasonable control, including but not limited to acts of God, war, terrorism, strikes or failures of telecommunications networks.

17. Changes to the Service & Terms

We may update the Service or these Terms at any time, for example to comply with legal requirements or reflect changes in our business. We will indicate the effective date at the top of this page and, where changes materially affect your rights, provide reasonable notice via the Service or email. Continued use of the Service constitutes acceptance of the revised Terms.

18. Assignment

We may transfer or assign our rights and obligations under these Terms in whole or in part at any time. You may not assign or transfer any of your rights or obligations without our prior written consent.

19. Severability & Waiver

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect. Our failure to exercise any right or enforce any provision shall not constitute a waiver of such right or provision.

20. Governing Law & Jurisdiction

These Terms and any dispute arising out of them are governed by the laws of England and Wales. You and GoalPhysique agree to submit to the exclusive jurisdiction of the courts of England and Wales.
